BOARD OF FINANCE

SPECIAL MEETING NOTICE

7:00 PM OCTOBER 22, 2007

TOWN HALL COMMISSION ROOM

Meeting called to order at 7:01 PM

Present: Chairman Jerry Sargent, Ms. Patty Kopas, Messrs. O’Brien, Atkinson, Nichols and Muller. Absent: Mr. Michael Carter.

Also Present: First Selectman Woody Bliss, Building/School Building Committee member Don Gary and Donna M. Anastasia, Secretary.

1. Discussion/decision regarding a supplemental appropriation of $58,000 for appeal of final decision of FAA Airspace Redesign Project.

First Selectman Woody Bliss explained to the board the 9 year plan by the FAA to re-route air traffic along the Philadelphia/Connecticut corridor. The proposed FAA plan would move current routes 25 miles northeast, vertically drop altitude from 1000 feet to 500 feet and space aircraft 3 miles apart instead of 5 miles. Mr. Bliss explained that many towns in Connecticut are in various stages of joining a suit that will attempt to appeal the FAA’s decision. Mr. Nichol’s concern was the specific impact on the town of Weston. Other towns such as Danbury, New Canaan and Stamford are more directly impacted by the change. Mr. Bliss listed Greenwich, Stamford, New Canaan, Darien, Norwalk, Wilton, Westport, Ridgefield and Pound Ridge New York as currently pursuing legal action.

There was discussion regarding alternatives such as increasing runways and taxiways at existing airports however this plan would take 10-15 years to complete.

The final decision of the FAA was approved September 5, 2007, the town of Weston would need to proceed before a deadline of November 4, 2007.

Mr. Bliss explained that the $58,000.00 would begin the first step along with neighboring towns to file the appeal, acquire lobbyists and begin a grassroots organization to respond to the issue.

Contributions from towns interested in the appeal process is based on 50% population size and 50% area; estimates are as follows: Westport $80,720.00; Redding $55,000.00; Greenwich $129,000.00; Norwalk $112,000.00; Stamford $145,000.00; Wilton $68,000.00; Ridgefield $77,000.00; New Canaan $71,000.00; Darien $72,000.00; Pound Ridge $50,000.00. The initial payment would require each town to deposit $30,000.00. There was discussion regarding the success of the appeal, further discussion regarding the impact on Weston and future expenses associated with the case.

2. Discussion/decision regarding the proposed settlement with Liberty Mutual.

Mr. Gary explained the settlement with Liberty Mutual Insurance Co. acting as the surety for the school building project. The original claim of $167,000.00 has been reduced through negotiations to a total of $50,000.00. $37,500.00 is available from the bond issue and $12,500.00 is required to pay off the aggregate amount of $50,000.00.

Motion: Chairman Sargent made a motion to approve an aggregate settlement of $50,000.00 for Liberty Mutual. Mr. Muller seconded, motion carries unanimously.

First Selectman Bliss requested to re-open discussion regarding the FAA decision and possibly bring in Judy Nevell, First Selectperson of Greenwich to discuss the issue.

Chairman Sargent entertained a motion to re-open the discussion. Motion fails.

With no further business coming before this board Chairman Sargent made a motion to adjourn, Mr. Nichols seconded.
