ZONING BOARD OF APPEALS HEARING

May 22, 2007

Present: Board Members: Chairman Richard Wolf, Carolyn Mulcahey, MacLeod Snaith, Nick Noyes and Alternate: Robert Gardner

Chairman Wolf called the Public Hearing to order at 7:30 p.m. and the Board Secretary read the notice of the public hearing into the record.

Town Attorney, Ken Bernhard, came forward and gave the Board Members a seminar on legal issues and to familiarize them with the obvious rules with respect to conducting a meeting.

Mr. & Mrs. Kelley came forward to discuss their request. They noted that the variance was originally approved in 2005. Mrs. Kelley noted that it is the same application that was approved in 2005, there have been no changes except for the contractor. She explained that the original contractor decided not to do their kitchen and the next contractor had to have back surgery. They are here tonight to keep within the time frame of the approval. Mr. Snaith asked to see a copy of the plans and the Kelleys presented the plot plan showing the proposed work. Discussion ensued and the Board Members reviewed the plans.

Following discussion, the public hearing was closed at 8:44 p.m.

DELIBERATION:

After some additional discussion, the following motion was made:

Mr. Noyes made a motion to approve the second request, in a letter dated 4/4/07, for an extension of the approval granted on 5/24/05 for a variance to Sec. 231.5, for construction of an addition 45’ from the front property line. The approval is extended for one year to 5/22/08.

Mr. Snaith seconded the motion. All in favor, the motion carried (5-0).

Ms. Mulcahey made a motion to approve the minutes from the 3/27/07 meeting and Mr. Gardner seconded. All in favor, the motion carried (5-0).

Mr. Gardner made a motion to approve the minutes from the 4/24/07 meeting and Ms. Mulcahey seconded. All in favor, the motion carried (5-0).

MOTION TO ADJOURN:

Mr. Snaith made a motion to adjourn and Mr. Noyes seconded. All in favor, the meeting adjourned at 8:53 p.m.
