| Zoning Board of Appeals Minutes - August 28, 2007 TOWN OF WESTON, CONNECTICUT ZONING BOARD OF APPEALS HEARING August 28, 2007 MINUTES Present: Board Members: Chairman Richard Wolf, Carolyn Mulcahey, MacLeod Snaith and Robert Gardner and Alternates: Robert Morse ________________________________________________________________________ Chairman Wolf called the Public Hearing to order at 7:30 p.m. and the Board Secretary read the notice of the public hearing into the record. 53 OLD FARM ROAD, owner, COHN, RICHARD P. AND PATRICIA M., Map 2, Block 5, Lot 41, variance to Section 321.5 of the Zoning Regulations to permit construction of an addition 20 ft. from the side property line. Mr. Cohn came forward to present his proposal. Mr. Snaith commented that they are being asked to decide on a variance without plans or even a schematic. Mr. Cohn stated that they have lived in their home for 12 years, when they bought it they were newlyweds and now have 3 children. They have looked at different possibilities for expansion and decided the best way would be to build out on the north side of the home. It has the most logical flow of the house and would create more family space and an additional bedroom. The septic system is directly in front of the house and they have an in-ground pool directly to the rear. Discussion ensued. Mr. Snaith commented that they seem to have other hardships other than the ones stated, noting that the lot is only an acre. He asked whether Mr. Cohn had considered building out over the area labeled "porch" which would create less encroachment. He further commented that they don’t have an interior layout of the house so it’s hard to see the connectivity and it would be difficult for him to make a decision without additional information. Discussion continued. Mr. Wolf explained that it would be difficult for the Board to make a decision on the variance without having some drawings to review that include dimensions. Mr. Snaith commented that there are legitimate hardships, but they would need to see that other alternatives have been explored and what is proposed is the most logical choice. Following additional discussion, the Board recommended that Mr. Cohn withdraw the application to review his options and re-apply when he has more information for the Board to review. Mr. Cohn then withdrew the application. ZONING BOARD OF APPEALS, AUGUST 28, 2007 PAGE 2 APPROVAL OF MINUTES Ms. Mulcahey made a motion to approve the minutes from the 7/24/07 meeting and Mr. Snaith seconded. All in favor, the motion carried (5-0). MOTION TO ADJOURN: Mr. Wolf made a motion to adjourn and Mr. Snaith seconded.
