1 Board of Selectmen’s Meeting

March 6, 2008

Present: First Selectman Woody Bliss; Selectman W. Glenn Major; Selectwoman Gayle Weinstein; Town Administrator Tom Landry; Administrative Assistant Judy DeVito, residents and member of the press.

This meeting was recorded and video taped and the tapes are available in the Selectmen’s office and the Building Department, respectively, for further reference.

Mr. Bliss called the meeting to order at 7:30pm

Pledge of Allegiance- David Goldberg lead the meeting in the Pledge of Allegiance.

Discussion/decision regarding the appointment of Jed Ferdinand to fill the vacancy (Charles Finkelstein) on the Conservation Commission for a term to expire December 15, 2011. Mr. Ferdinand said that he has lived in Weston since 1999. He is a lawyer that had practiced in New York City for five years and now in Fairfield County for nine years. He was trained as an environmental lawyer and is interested in the environment.

Ms. Weinstein made a motion to appoint Jed Ferdinand to fill the vacancy of Charles Finkelstein on the Conservation Commission for a term to expire December 15, 2011. Mr. Major seconded and the motion passed unanimously.

Discussion/decision regarding a Resolution in support of the Connecticut Municipal Consortium for Fiscal Responsibility. Ms. Weinstein made a motion to support a resolution in the support of the Connecticut Municipal Consortium for Fiscal Responsibility. Mr. Major seconded and the motion passed unanimously. A copy of the resolution is attached to the minutes.

Discussion/decision regarding the Commission on Aging proposal for a Senior Tax Freeze. After some discussion Mr. Major said Sec. 10-23 Maximum relief item C. should read all abatement requests will be funded first, followed by deferral requests, and if the request for any program exceed the aggregate limit, then such request will be prorated.

Mr. Major made a motion to set a public hearing for April 3, 2008 at 7:00pm on the revised Tax Relief for the Elderly Ordinance. Ms. Weinstein seconded and the motion passed unanimously.

Discussion/approval of the minutes of the January 17th Board of Selectmen’s meeting. Mr. Major made a motion to approve the minutes of the Board of Selectmen’s meeting of January 17, 2008 as amended. Ms. Weinstein seconded and the motion passed unanimously.

Any other business to come properly before the meeting- None

At 7:50pm Ms. Weinstein made a motion to enter into Executive Session. Mr. Major seconded and the motion passed unanimously.

Executive Session- Morehouse field impact settlement discussion (Rand McNeil) and heart and hypertension case status. (Tom Landry).

Attendance and Discussion: The meeting was convened at 7:57 pm in the First Selectmen’s Office by Chairman Bliss, with Mr. Major and Ms. Weinstein present. Also present was Town Administrator Landry.

The first item of discussion in the executive session was to receive an update on the status of the Palmiero heart and hypertension claim. Mr. Landry provided updated information on the status of the claim.

The second item consisted of a request by resident Rand McNeil that the Town provide payment to him, as he alleges that the Town’s use of irrigation at Morehouse Fields caused his well to go dry last summer, and resulted in his needing to drill a new well at property he owns on Newtown Turnpike. At 8:13 pm, Mr. McNeil joined the executive session to make his presentation, with the assistance of Mr. Hatch.

After discussion of both items, the Board voted unanimously (Mr. Major, motion; Ms. Weinstein second) to end executive session at 8:39pm and reconvene in open session.

ADJOURN: At 8:40 pm, a motion (Mr. Major, Ms. Weinstein second) to adjourn the meeting passed by unanimous vote.
